The European Courts and the Security Council: Between "Dédoublement Fonctionnel" and Balancing of Values
2009
The recent case law of various international tribunals facing questions related to UN Security Council resolutions shows the clear tendency to grant primacy to the UN legal order. This trend, far from being well founded on formal arguments, appears to be a tribute to a legal order perceived as superior, and, at the same time, is revealing of the ‘value oriented’ approach followed by the courts. Such an approach can be categorized from a theoretical perspective in the light of Scelle's theory of relations between legal orders, whereby the courts implement in their respective legal orders values stemming from the UN legal order. Various critical remarks can be advanced in relation to this att…

State and Society - the Legal Culture in the Interdisciplinary Comparison between Legislation and Family Law and between Law in the Book and Law in A…
2022
In my opinion Family Law represents the litmus test of the setting of the relationship between the law and the "legal culture" of a People. Furthermore this is the field where the delta between the combinations of the law in the books with the law in action is wider. With this paper I intend to demonstrate, how the cultural, social and political-economic evolution of a given society (in particular the contemporary Italian society and more generally the European societies) accentuates the disconnection with "positive law" and how "family law", despite having "universal" aspects, is so intimately linked to society so that it represents the fulcrum of legal culture reflecting the ideas, the tr…
The taint of torture and the brazilian legal system
2019
In Brazil, the practice of torture intertwines deeply with its own history. The literature on the subject has had a greater intensification on its registers during the Dictatorial Regime (1964 to 1985). In spite of the Brazilian Constitution of 1988, Brazil only makes efforts to investigate the crimes of torture of this period to comply with the provisions of the United Nations in 2011. Within this scenario, the NationalTruth Commission (Law 12.528, of November 2011) was created with the purpose of clarifying the facts and circumstances of cases concerning human rights violations, as well as the Law on Access to Information (Law 12.527 of November 2011), which have regulated the constitutio…
La Corte costituzionale apre al divieto di retroattività del novum penitenziario in malam partem.
2020
With a courageous judgment, the Constitutional Court extends the application scope of art. 25, par. 2, Cost. in the criminal enforcement sector. Censoring the living law, the Court states the prohibition of the retroactivity of the measures more afflictive introduced by law no. 3 of 2019 to convicts who committed the fact before its entry into force. The Author, after dwelling on the new paradigm of "European legality", retraces the salient passages of the decision, from which it draws the innovative message of the Judge of the laws.

Hybris e rivoluzione. Il caso della rivolta cilena
2023
This paper discusses the binomial hybris and revolution. In particular, the question of whether the excessive dominants’ arrogance, who have too much both in material and symbolic terms, is sufficient to explain the deflagration of an insurgency and the interruption of a legal order. The question will be addressed by interweaving the reflections of authors who have discussed this topic with a material collected by the author through a legal-political ethnography conducted in Chile during the revolt that broke out in October 2019 and led to a new constituent phase. Categories and definitions used in this text are partly borrowed from the course devoted to political change and revolution taug…

In this article I propose a reconstruction of Costantino Mortati’s view of the legal order, the state and the mate…
